THE TEXAS FORECLOSURE PROCESS

While most things are bigger in Texas, the foreclosure timeline is the SHORTEST  of all 50 states - usually 60 days or less! 

That is why it is CRITICAL that you take ACTION, especially if you have received a Letter of Demand informing you that you have 20 days to bring the mortgage current.  Once the 20 days runs out, the lender may issue a foreclosure notice which must be: 1) filed with the county clerk; 2) mailed to the borrower at their last known address; and 3) posted in the county courthouse and all of this MUST occur at least 21 days before the foreclosure sale. 

However, if these procedures are not followed EXACTLY, the foreclosure attempt is VOID and the foreclosure can be STOPPED.  Additionally, there are other things the lender may have done they weren't supposed to do, or things they have not done that they were supposed to do.  Any of which make the foreclosure attempt VOIDABLE meaning it can be STOPPED!

The foreclosure sale is always on the first Tuesday of the month even if that Tuesday is a legal holiday.  The sale is on the courthouse steps by auction to the highest bidder for cash. 

There is NO right of redemption in Texas.
